This contract is being signed between Janis Roze Ltd. 1. Subject Contract

A distance contract is an agreement between the Buyer and the Company based on the Company's offer via the Internet. The distance contract applies to all orders placed in the Company's online store.

2. Entry into Force of the Distance Contract

The distance contract comes into force as soon as the Buyer has placed the order via the Internet and received confirmation from the Company, which is automatically generated by the Company via electronic mail after the completion of the order. Orders and order confirmations are considered received when they are accessible by the parties to whom they are addressed.

3. General terms for ordering the product

The Buyer can also do the shopping in the Company's online store without prior registration, this does not affect the terms of execution of the Contract.

To place an order in the online store:

1. The Buyer must press the "Add to cart" button next to the item of interest.

2. To order the selected product, click on the icon on the upper right side of the page, where information about the contents of the Buyer's shopping cart is shown. It is possible to return to the online store, select additional products and then return to the shopping cart again by clicking on the icon at the top right of the page, where information about the contents of the Buyer's shopping cart is shown.

3. To place an order, it is necessary to fill in information about the Buyer. To complete the order, the Buyer must agree to the terms mentioned on the page. After that, the "Order" button becomes active, and when you press it, the order is registered. After registering the order, the text "Thank you! Your order has been saved. We will contact you soon" is displayed.

Orders can be placed:

• at any time of the day, when placing the order in the online store;

• by sending an e-mail to [email protected]

• When placing an order via e-mail, you must specify:

• product name;

• bar code of the product (preferred);

• product price;

• name, surname / company name;

• delivery address;

• phone number;

• e-mail;

• for a legal entity - company reg. no. (also VAT payer number and legal address);

• for a legal entity - bank name and bank IBAN.

Orders are processed on weekdays from 10 a.m. to 5.30 p.m. If the order is placed at a different time, it will be processed the next business day.

After receiving the order, if necessary, the Company will contact the Buyer to clarify the information and/or to confirm the order.

4. Order payment terms

The Buyer can pay for the purchase in the online shop:

• by internet banking, using a debit card issued by credit institutions;

• with our Company’s JĀNIS ROZE Gift card;

• making a transfer (only for legal entities);

• using Swedbank's internet bank;

• paying for the order at the time of receiving the Product (possible only if choosing to receive it in the store).

When the information in the order form is filled in, an invoice is sent to the e-mail address specified by the Buyer, which must be paid before receiving the product. The invoice contains all the data required for payment. The purchase is considered paid and the goods are delivered after receiving the money in the Company's current account.

Upon receiving the product, the Buyer is issued an invoice.

5. Delivery Terms

The goods can be received:

• in any of the Company's stores chosen by the Buyer in the territory of the Republic of Latvia (the list of our stores is attached) during the working hours specified in the online store. Receiving goods in the Company's store is free of charge.

• With direct delivery only in the administrative territory of Riga municipality, according to the delivery terms and delivery service prices specified in the online shop. Delivery is provided to the address specified by the Buyer. The buyer must ensure the acceptance of the goods. The product is not delivered to places where it is forbidden for vehicles to stop - in such cases, the nearest place where stopping is allowed must be indicated in the order.

• via "Latvijas pasts/Latvian Post", reg. no. 40003052790, in accordance with the delivery terms set by "Latvijas pasts" and the prices of the delivery service set in the online shop.

• with the help of the courier service provider and the prices of the delivery service specified in the online shop.

The delivery fee is not included in the specified product price!

The company reserves the right not to deliver the product if the Buyer has not paid for the product.

Product prices are indicated with Value Added Tax (VAT). The price does not include delivery charges. Shipping charges may vary depending on the delivery region and product weight/size/packaging.

The company is not responsible for the subjective characteristics of the goods, e.g. books, data carriers, audio recordings, digital content or other content!

6. Warranty

The warranty for the products offered in the company's online shop is provided in accordance with the warranty service conditions set by the manufacturer of the product, but not less than 2 years.

If claims regarding the quality of the purchased product have arisen during the warranty period, the Buyer can contact the Company with documents confirming the product and payment. If a manufacturing defect is detected, the Company undertakes to exchange the product for a suitable one. If a defect is caused by the Buyer himself during use of the product, the product will not be changed.

Warranty obligations are cancelled in cases when:

• the product intended for use for personal (household) needs has been used for other purposes;

• the product has been used without observing the warnings specified in the instructions;

• it is concluded that the product has been unqualifiedly repaired;

• changes have been made to the design of the product;

• the serial number of the product is illegible, has been changed or deleted.

Warranty obligations are cancelled in cases when:

• foreign bodies, insects, liquids or other substances getting inside the product;

• natural disasters, fires, as well as accidents.

The buyer's claims about the quality of the purchased goods are dealt with in accordance with the requirements of the Cabinet of Ministers Regulation No. 631 of August 1, 2006 "Procedure in which a consumer's claim for a product or service that does not meet the terms of the contract is applied for and considered".

7. The Execution time of the Distance Contract

The company undertakes to fulfil the terms of the distance contract in the territory of the Republic of Latvia no later than 30 days after receiving the order from the Buyer or outside the territory of the Republic of Latvia according to the deadlines set by the online store.

If the Company cannot fulfil the contract due to the lack of goods ordered by the Buyer, the Company shall inform the Buyer thereof. In that case, the Company can offer the Buyer an equivalent product or refund the money for the purchase.

8. The Right of Withdrawal

According to the Consumer Rights Protection Law of the Republic of Latvia, the Buyer can use the right of withdrawal and unilaterally withdraw from the distance contract within 14 calendar days and return the product purchased in the online shop to the Company.

The deadline for using the right of withdrawal counts from the day the Buyer has received the product or part of the product (products) (in cases where the order is partially fulfilled).

The buyer cannot use the right of withdrawal if:

• the ordered goods cannot be returned due to their nature (e.g. hygiene items, etc.), or they are perishable or can be quickly used up;

• The buyer has opened any packaging of the data carrier.

In accordance with Article 12, Part 6 of the Law on the Protection of Consumer Rights, the Buyer is responsible for maintaining the quality and safety of the goods during the period of being ableto use the right of withdrawal. The company reserves the right to refuse the Buyer to use the right of withdrawal or to withhold a compensation fee in case the product is damaged, in case of careless handling of the product during its use or when failing to follow the instructions, if the product's original packaging is lost or if its packaging is significantly damaged.

9. Procedure of Returning Goods

When returning the purchased item, the Buyer must present the Buyer's identity document and a document that confirms the purchase. The Buyer can return the product according to the distance contract within 14 calendar days.

10. Confidentiality

The company undertakes not to disclose nor share any information about the Buyer to third parties without the written consent of the Buyer, except in cases where the laws and regulations of the Republic of Latvia or this contract are violated.

11. Other Regulations

By placing the order and entering the necessary information, the Buyer confirms that he/she is familiar with and agrees that the data provided by him/her are used by the Company to accept the Buyer's order and deliver goods in accordance with the requirements of the laws of the Republic of Latvia. By entering information, the Buyer agrees that notifications related to the processing of the Buyer's order will be sent to the specified e-mail address.

The Seller reserves the right to inform the Buyer about new goods, discounts, services.

Registered Buyers can view the terms of electronica contracts later on the website, and the Company stores the data.

Descriptions of the products are created based on the information provided by the manufacturers of the product, descriptions and images are informative, operational changes are possible. According to the changes determined by the manufacturer, the product package or parameters may be adjusted or changed.

Additional information on whether the item of interest is in stock or in one of the stores can be found out by the Buyer on working days from 9.00 a.m. to 5.30 p.m. by calling the indicated contact number.

12. Terms of the agreement

The Agreement comes into force at the moment when the Buyer has placed an order for the Goods, and is valid until the contracting parties have fully fulfilled their obligations to each other.
