Information about using one’s refusal rights

REFUSAL RIGHTS

  • In accordance with the Consumer Rights Protection Law of the Republic of Latvia a Buyer can use his refusal rights and unilaterally deviate from the distance contract in 14 days time and return the product to the Enterprise that was bought in the web shop.
  • The established date of the refusal rights starts on the day when the Buyer has received the product (or a part of the products if the order is completed partially).
  • The Buyer cannot use the refusal rights if:

 

  1. The ordered products cannot be returned due to their nature (f. e., hygiene products etc.)
  2. The Buyer has opened any of the product’s wrapping (package)
  • In accordance with the 6th part of the 12th clause of the Consumer Rights Protection Law the consumer is responsible for keeping the product’s quality and safety in case of using his or her refusal rights during the 14 days time term. The Enterprise keeps its rights to reject the buyer’s refusal rights or to withhold the compensation charge in case when the returned product is damaged, because of being inattentive or ignoring the instructions for use, as well as when the original package of the product is lost or substantially damaged.
  • To use your refusal rights, you have to inform us by mail or via e-mail (Janis Roze LTD, legal address: 3 Krisjana Barona Street, Riga, LV-1050, phone number: +371 67501562, e-mail address: info@jr.lv) about your decision to decline this contract.
  • To observe the term of your refusal rights please send your refusal notice before the refusal term ends.

 

SEQUEL TO THE REFUSAL

  • If you refuse this contract we will refund all the payments you have made, including the delivery charges, (excluding additional charges concerning the payment method if you have not chosen the standard delivery type which is the cheapest delivery type) without any delays and in any case not later than in 14 days from the day when you have informed us about your refusal. The refund will be made using the same payment method that you used when paying for the product (excluding when you have clearly agreed for using a different method). In any case you will not be charged for this refund in any way. We can only hold up the refund until the moment we receive the product back or when you let us know that the product has been sent back and after we make sure that the product is not damaged and check on its visual condition managing diagnostics in the manufacturer’s authorized service.
  • You have to send or return the product/s to us without any unreasonable delay and in any case not later than in 14 days time from the day when you let us know that you are refusing this contract. The term will be observed if you send the product/s before the end of the 14 days term.
  • When returning the product/s the Buyer has to prove his/her identity by presenting identity documents and showing a document (receipt) that proves the purchase.
  • You are responsible only for the value decrease of the product if you use the product/s for other objectives than it is made for. For example, if the product/s is (visually or physically) damaged, spent or outworn (product or its component) for more than 5 %.
  • The consumer is responsible for keeping the product/s’ quality and safety during the refusal rights realization term (including keeping the package perfect and impeccable).

 

THE CONSUMER CANNOT USE THE REFUSAL RIGHTS:

In accordance with Regulations of Minister Cabinet (20/05/2014) – number 255 – Regulations about distance contract in the 22nd article including IF:

  • Product price depends on financial market fluctuations that seller cannot control or influence and that can turn up in the refusal rights term;
  • Products are made following consumer’s instructions or are clearly personalized;
  • Products are easily damaged or with short expiry date (that is coming to an end);
  • Consumer has opened the product and/or security seals are damaged;
  • Product has irreversibly mixed with other products due to its qualities;
  • Consumer has opened wrapping of an audio recording, video recording or computer program;
  • Product is visually or physically damaged and the value of the product has decreased;
  • Contract is signed about digital content supply that is not delivered physically and if consumer has agreed to receive digital content and confirmed losing his/her refusal rights;
  • If product has been used in the way that cannot be characterized as principle of good faith and has been used for other targets than it is supposed to.

 

When returning the product/s the Buyer has to prove his/her identity by presenting identity documents and showing a document (receipt) that proves the purchase.
